1. Agreement to these terms
These Terms of Service (“Terms”) form an agreement between you and QUANTUM LEAP TELECOM LLC (“Quantum Leap Telecom,” “we,” “us”), a Utah limited liability company headquartered at 7533 S Center View Ct, Ste N, West Jordan, UT 84084. By using our website, placing a pre-order or order, or using our services, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy.
If you accept on behalf of a company or other organization, you confirm that you have authority to bind it. Business services may also be governed by a master service agreement or service order (“Service Order”); if a Service Order conflicts with these Terms, the Service Order controls for that service.
2. Our services
We offer residential fiber internet, business fiber and dedicated internet access, SD-WAN, managed WiFi and private cloud. Service descriptions, prices and plan features are published on our website or stated in your quote or Service Order.
- Residential fiber is being built in phases in Utah. Availability depends on your address and on construction progress.
- Business fiber and dedicated internet access are quoted per location along our Salt Lake Valley routes.
- Private cloud services are delivered from our US cloud regions as described on our website and in your Service Order.
3. Pre-orders and availability
A pre-order reserves your place for installation once service is available at your address. No payment is taken for a pre-order, and it is not a guarantee that service will be available by a specific date. Construction schedules can change because of permitting, weather, supply and other factors outside our control; published dates are targets.
We will confirm your plan, price and installation date with you before activating service. You may change or cancel a pre-order at any time before installation at no cost.
4. Eligibility and your account
You must be at least 18 years old and able to form a binding contract to order services. You agree to provide accurate information, to keep your contact details current and to keep your account credentials confidential. You are responsible for activity on your account and service, including use by others in your household or organization.
5. Pricing, billing and payment
Prices are shown in US dollars and exclude applicable taxes and government fees unless stated otherwise. Residential services are billed monthly in advance, starting on the date service is activated. Business and cloud services are billed as set out in your Service Order; usage-based cloud charges are billed in arrears.
Payment is due by the date on your invoice. If a residential payment is late we may charge a late fee of $10; late charges for business services are stated in your Service Order. We may suspend service for non-payment only after notice, as described below.
We may change prices with at least 30 days’ notice. Price changes do not apply during a committed term, except for changes in taxes and government fees.
If you believe a bill is incorrect, contact us within 60 days of the invoice date. We will investigate in good faith and will not suspend service over a disputed amount while we review it.
6. Term, cancellation and fees
Residential plans are month-to-month. You may cancel at any time; service continues through the end of the current billing period. Residential plans have no early termination fee.
Business services with a committed term (for example one or three years) may carry early termination charges, as stated in your Service Order.
7. Equipment
Equipment we provide — such as the optical network terminal (ONT), gateways, mesh nodes and SD-WAN appliances — remains our property unless you purchase it. Please keep it in a safe place, do not modify it, and return it within 30 days after service ends. We may charge the replacement cost of equipment that is not returned or is damaged beyond normal wear.
You may use your own router behind our ONT. We are not responsible for the performance or security of equipment we do not provide.
8. Installation and access
You authorize us and our contractors to access your premises at scheduled times to install, maintain, repair and remove our facilities and equipment. If you do not own the premises, you are responsible for obtaining the owner’s permission. We take reasonable care to minimize disruption and to restore disturbed areas.
9. Speeds and performance
Advertised speeds are the maximum wired speeds provisioned for your plan, and we publish typical speeds and latency for every residential plan. Actual speeds can vary because of your devices, in-home wiring, WiFi conditions, the capacity of remote servers and network conditions outside our network.
We manage our network in a transparent, application-agnostic way, as described in our Acceptable Use Policy. We do not block, throttle or prioritize lawful traffic based on its source, destination or content.
10. Service levels and outages
Business services may include a service level agreement (SLA) with availability, latency or repair-time commitments and service credits, as stated in your Service Order. Service credits are the sole remedy for failure to meet an SLA.
We perform scheduled maintenance during low-traffic windows and give advance notice when maintenance may affect service. Report outages to our 24/7 Network Operations Center at [email protected].
Residential customers affected by an outage caused by our network that lasts more than 24 consecutive hours may request a pro-rated credit.
11. Suspension and termination
We may suspend or terminate service if you fail to pay undisputed amounts after notice, if you materially violate these Terms or our Acceptable Use Policy, or if needed to protect our network, customers or the public from harm. Where practical, we will give notice and an opportunity to fix the problem before suspending service.
12. Your content and data
You are responsible for the content you transmit or store using our services and for complying with applicable law. You keep all rights to your content and Customer Data. Unless you purchase a backup service, you are responsible for maintaining backups of data stored in our cloud.
When a cloud service ends, we make your Customer Data available for export for 30 days and then delete it in line with our data-handling procedures, unless the law requires otherwise.
13. Intellectual property
Our website, software, documentation, name and logos are owned by Quantum Leap Telecom or our licensors and are protected by intellectual property laws. You may not copy, modify or distribute them except as permitted by law or with our written permission.
14. Disclaimers
Except as expressly stated in these Terms or a Service Order, services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that service will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent permitted by law, Quantum Leap Telecom is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the services is limited to the amounts you paid us for the affected service in the three months before the claim arose. These limits do not apply where the law prohibits them.
16. Indemnification
You agree to defend and indemnify Quantum Leap Telecom against third-party claims arising from your violation of these Terms or our Acceptable Use Policy, or from content you transmit or store using our services, except to the extent caused by our own negligence or misconduct.
17. Governing law and disputes
These Terms are governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law rules.
Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and both parties consent to their jurisdiction. Either party may bring an individual claim in small claims court where eligible.
18. Changes to these terms
We may update these Terms from time to time. We will post changes on this page and, for material changes that affect your service, notify you at least 30 days in advance. If you do not agree with a material change, you may cancel the affected service before it takes effect without an early termination fee.
